The Supervision Implementation by the Notary Supervisory Council on Notaries Suspected of Violating the Notary Position Act

Abstract:
This paper discusses the implementation of supervision by the Notary Supervisory Council on notaries suspected of violating the Notary Position Act (UUJN), specifically Law No. 30 of 2004 as amended by Law No. 2 of 2014. Supervision of the duties and positions of notaries is carried out by the government, as stipulated in Article 2 of the UUJN, which states that notaries are appointed and dismissed by the Minister (in this case, the Ministry of Law and Human Rights). Therefore, since the Ministry of Law and Human Rights has the authority to appoint and dismiss notaries, it is evident that the ministry also has the authority to oversee the execution of notarial duties and positions. This supervisory role has been delegated to oversight bodies such as the Central Supervisory Council (MPPN), the Regional Supervisory Council (MPWN), and the District Supervisory Council (MPDN). The purpose of this supervision is to ensure that notaries perform their duties and functions properly as mandated by the UUJN. However, in practice, there are still cases where notaries fail to carry out their duties and responsibilities as required by the UUJN, despite the government's (Ministry of Law and Human Rights) establishment of authorized supervisory bodies, namely the MPPN, MPWN, and MPDN. Therefore, it is important to examine and analyze in depth the extent to which these supervisory bodies (MPPN, MPWN, and MPDN) have effectively carried out their oversight responsibilities over notaries suspected of violating the UUJN.
