Medical Negligence Reform and Executive Leadership: Building Safer Healthcare Systems Through Legal Innovation

This study aims at systematically reviewing the connection between medical negligence reform, executive leadership, and law innovation, to boost patient safety and to improve healthcare accountability. The review draws on 35 studies published between 2021 and 2026 and is based on evidence from studies of leadership, patient safety in healthcare, malpractice law and healthcare governance. The findings highlight the costs, adversarial, and reactive nature of traditional negligence systems, and point to the potential for improving transparency, prevention and institutional learning through legal innovation, including no-fault compensation schemes, alternative dispute resolution, digital incident reporting, and legal compliance assistance using AI. Safety culture, regulatory compliance, risk management, organizational responsibility are also critical areas of focus in the review-leading to executive leadership. A combination of legal modernization, proactive compliance, leadership accountability and technological solutions are key elements to any integrated approach to support the reduction of preventable harm and the improvement of the quality of healthcare services. The study provides an interdisciplinary approach to creating safer, more responsive and accountable healthcare systems.
