Non-Penal Policies for Preventing Domestic Violence in Aceh

Abstract:

Domestic violence prevention is governed by Article 12 of Law Number 23 of 2004 on the Elimination of Domestic Violence, Qanun Number 9 of 2019 on the Management of Violence Against Women and Children, and further delineated in Governor Regulation Number 57 of 2023 on the Implementation of Integrated Prevention and Management of Violence Against Women and Children. These three regulations illustrate the government's commitment to combating domestic abuse. Domestic violence constitutes not merely a legal concern but also a societal issue necessitating non-penal strategies to eliminate and reduce the elevated incidence of domestic violence in Aceh. The methodology employed in formulating this work is the empirical juridical research approach. This paper aims to analyse and elucidate the Non-Penal Policy for the Prevention of Domestic Violence in Aceh. The research findings indicate that addressing domestic violence necessitates a non-penal approach to effectively diminish its high prevalence, as punitive measures alone are deemed inadequate in tackling the underlying causes and consequences of this violence. The implementation of Law Number 23 of 2004 on the Elimination of Domestic Violence, Qanun Number 9 of 2019 on the Management of Violence Against Women, and Governor Regulation Number 57 of 2023 on the Execution of Integrated Prevention and Management of Violence Against Women and Children constitutes the primary framework for preventing domestic violence. Law enforcement authorities engage in outreach and distribute banners on the prevention of domestic violence.
