Granting of Ownership Rights to Former Land Use Rights (HGU) in Nagan Raya Regency

Abstract:

In 2016, the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency granted an extension of the Right to Cultivate (HGU) No. 1 of 1991 covering an area of 1,595.5 ha. from 3,014 Ha, through his Decree No. 22/HAK GUNA USAHA/KEM-ATR/BPN/2016 dated May 13, 2016, which resulted in part of the land of the right to cultivate covering an area of 1,418.5 Ha returning to state land. Former HGU state land has been specifically regulated through Goverment Regulation (PP) No.224 of 1961 as amended by PP No. 41 of 1964, where former HGU land becomes the object of land to be distributed to parties with certain criteria. In addition, control over state land has also been regulated through land clearing permits based on the Decree of the Head of the BPN No. 2 of 2003. After possessing the land for three years based on a land clearing permit, the permit holder can apply for land rights. However, in practice, the granting of 56 (fifty-six) parcels of land ownership rights on former HGU state land in Nagan Raya Regency was done through independent land ownership rights aplications at the Nagan Raya Regency Land Office in the same year the land changed its status from HGU to land directly controled by the state. This study aims to analyze the implementation of land ownership rights on former HGU state land in Nagan Raya Regency.
