The Application of Restorative Justice in Resolving Phishing Crimes through the Package Kit Application (APK) in the Aceh Regional Police

Abstract:

The Regulation of the Indonesian National Police Number 8, 2021, outlines the methods and prerequisites for implementing restorative justice within the Indonesian National Police. This law restricts the implementation of restorative justice to minor criminal offences with a maximum penalty of five years and does not significantly jeopardise public interest. The first prerequisite for implementing restorative justice is a consensus between the offender and the victim, alongside the potential for rehabilitating social connections that were adversely affected by the crime. The Perpol lacks specificity regarding minor offences or defined thresholds for the severity or value of losses appropriate for restorative justice, and it does not impose a limit on the extent of losses if restorative justice is attained, thereby creating the potential for evasion of criminal liability without regard to the magnitude of the loss. The study employs the empirical juridical research approach. This research aims to examine and elucidate the implementation of restorative justice in addressing phishing offences via the Package Kit Application (APK) under the jurisdiction of the Aceh Police. The research findings demonstrate that the application of restorative justice for phishing offences within the jurisdiction of the Aceh Police has proven ineffective and remains well below the standards and protocols established in Perpol Number 8, 2021 on Restorative Justice.
