Land Rights as Objects of Waqf and their Registration

This study aims to discuss the types of land rights that can be endowed, or land rights that may serve as objects of waqf, as well as their registration, in order to establish legal certainty and legal protection for waqf land. This is important because the object of waqf under the Waqf Law (Law No. 41 of 2004) is not limited to freehold title (Hak Milik) as stipulated in previous regulations (Government Regulation No. 28 of 1977). Moreover, to ensure legal certainty, the land rights that are endowed must be registered at the Land Office. Accordingly, waqf can be optimized to realize the potential and benefits of waqf land.
