Legal Consequences of Sale and Purchase of Uncertified Customary Land

Abstract:
Engaging in the purchase and sale of uncertified land entails a significant risk of disputes owing to the lack of formal documentation at the Land Office. This scenario transpires in the context of land transactions in Gampong Lamdingin, Banda Aceh City, where sales and purchases are executed based on a letter of inheritance serving as evidence of customary ownership. The seller and buyer had reached an agreement, and the buyer had made full payment for the land. The buyer incurs both material and legal damages, as the anticipated land rights cannot be acquired despite having fulfilled payment and reached an agreement with the seller. This study employs a combination of normative legal research methodologies and empirical methods. This research aims to examine and elucidate the legal ramifications of the purchase and sale of unregistered customary land. The research findings suggest that the sale and acquisition of uncertified land entail legal ramifications that compromise legal certainty, equity, and utility.
