The Essence of Absolute Authority in the Decision of the Banda Aceh District Court Number 40/Pdt.G/2020/PN Bna

Abstract:
The Banda Aceh District Court in Decision Number 40/Pdt.G/2020/PN Bna refused to adjudicate the case a quo because the dispute between the Plaintiff and the Defendant is an employment dispute. The legal fact that can be proven in the trial of the case is a default matter, where the Defendant's actions meet the elements of default following Article 1243 of the Civil Code, which includes failing to fulfill obligations, having been declared negligent, yet still not executing the contents of the scholarship agreement No. 014/K/YPNAD/VI/2015. Therefore, this case falls under the absolute jurisdiction of the District Court, not the Industrial Relations Court. This research is a normative juridical study, approaching various regulations, jurisprudence related to this decision, and other literature relevant to this research. The data collection technique was conducted through library research aimed at obtaining legal materials related to the problem formulation being studied.
