The Roles of Nadzir in Efforts to Improve the Registration of Waqf Land in Bireuen Regency

Abstract:

According to Government Regulation Number 42 of 2006 regarding the execution of waqf, unregistered waqf land must be promptly registered. Nadzir, the waqf asset manager, oversees the registration of waqf land; without registration, the land lacks legitimate legal protection. As the waqf manager, Nadzir plays a strategic role in the registration of waqf land, which impacts legal certainty and legal protection for waqf assets. In practice, the function of nadzir as the waqf manager has been suboptimal, as the lack of waqf land certificates may lead to potential conflicts or claims by the heirs of the waqif. This study employs an empirical legal methodology utilising a qualitative approach. This research aims to analyse and elucidate the role of Nadzir in enhancing the registration of Waqf land in Bireun Regency. The research findings reveal that Nadzir in Bireuen Regency has largely failed to fulfil their responsibilities in registering waqf land, attributed to insufficient intrinsic legal awareness, inadequate governmental support and outreach, perceived exorbitant administrative costs and complex procedures, the assumption that waqf land is safeguarded by public or communal usage, and deficiencies in regulation and governmental oversight.
