Law Enforcement on Unlawful Death Committed by the Police

Abstract:

The act of unlawful death lacks precise restrictions and does not impose penalties on the offenders. In Indonesia, unlawful death occurs with regularity. Nonetheless, as the offenders of unlawful death are state entities and lack precise restrictions, these acts of unlawful death conclude without stringent penalties and legal clarity. In summary, while there are no explicit provisions about unlawful death, Articles 338 to 351 of the Criminal Code already address the offence of homicide. Nonetheless, these articles do not pertain to all offenders of unlawful death; rather, they apply solely to some offenders of unlawful death. The methodology employed in the formulation of this study is the normative juridical research approach. This paper aims to examine and elucidate the legal framework governing unlawful death actions perpetrated by police officers. The research findings indicate that law enforcement regarding unlawful deaths perpetrated by police officers is suboptimal, as the Chief of Police's regulations mandate only a unilateral chronological report from officers who discharge firearms to their superiors. This leads to reports that are inadequate and perceived as deficient in both mastery and application, thereby failing to adhere to proper procedures.
