Inheritance Distribution to Descendants Heirs of “Patah Titi” in Bener Meriah Regency

Article 185 Paragraph (1) of Presidential Instruction No. 1 of 1991 concerning the Compilation of Islamic Law (KHI) states that "Heirs who die before the Testator, their position can be replaced by their children, except those referred to in Article 173". However, in the Gayo community in Bener Meriah, in the distribution of inheritance, there is no such thing as a replacement of place (plaatsvervulling) which is very detrimental to the Testator and is considered unfair by one or several parties of the Heirs.
