The Distribution of Inheritance Based on the Inheritance System of the Batak Mandailing Community

Inheritance distribution is a very important part of civil law, and is one of the regulations that apply in Indonesian society. In reality, inheritance disputes often occur in society, generally focusing on the distribution of inheritance. For Islamic communities, the inheritance distribution system in addition to that contained in the fiqh book and the Compilation of Islamic Law (KHI), the community also distributes inheritance according to the customs of each ethnic group, such as the community of South Tapanuli Regency. The purpose of the study is to analyze the existence or position of brothers as heirs in the customary law system in South Tapanuli Regency and the understanding of Ulama in the distribution of inheritance in South Tapanuli Regency and the extent of the role of Dalihan Na Tolu in the distribution of inheritance in South Tapanuli Regency.
