Implementation of Online Dispute Resolution Policy as an Alternative Choice for Resolution of Business Disputes

Abstract:
The presence of the covid-19 outbreak in people's lives has positive and negative impacts on life. The positive side for people is that they are increasingly technologically literate, as evidenced by the increasing information technology in the fields of business and transactions, while the negative side of Covid 19 is related to technological advances that make it difficult for humans to interact directly. Information and communication technology, especially internet media access, has made it easier for people to access social e-commerce and e-commerce marketplaces and find what they want just by using a smartphone. The e-commerce mechanism involves two parties: Entrepreneurs or sellers who sell (merchants), and buyers who want to make transactions via the Internet. ODR is used by parties from different countries without having to meet face to face, so that dispute resolution through court is rarely done and is a last resort. Therefore, a suitable, effective and efficient method must be sought, in order to be able to resolve disputes easily, quickly and cost-effectively. This practice is often interpreted as Alternative Dispute Resolution, based on Article 1 number 10 of Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution (APPS Law). The risk of e-commerce negotiations requires a way to resolve quickly and at low cost. With the increasing number of e-commerce disputes, there is hope that disputes can be resolved online using ODR. The disputes that occur involve many parties from different spaces and regions, in this case ODR is considered to have advantages, in terms of time and cost efficiency, compared to resolving other disputes.
